On January 29, 2025, the U.S. International Trade Commission (hereinafter referred to as ITC) ruled that Altria’s Njoy Ace e-cigarette product infringed four of Juul Labs’ patents and ordered a ban on the import and sale of infringing related products to the United States until the patents expire in 2034 and 2037.
This time, the full committee made a final ruling, which means Altria and Njoy need to stop importing Njoy Ace devices and cigarette cartridges within 60 days, unless the Trump administration’s U.S. Trade Representative’s Office overturns the ITC’s ruling.In this regard, Altria said in a statement: "The Office of the United States Trade Representative is currently conducting a 60-day review of the ITC's decision and may overturn the ITC's decision. If the Office of the Trade Representative does not overturn the ITC's decision, the exclusion order and stop order will take effect on March 31. If the Office of the Trade Representative notifies the ITC of approval before the end of the 60-day period, the effective time will be earlier."
Altria said that if the U.S. Trade Representative's Office does not reject the ITC's ruling, Njoy will continue to work on product solutions to resolve all involved patents.
